Empresas estatais e parcerias institucionais

This paper tackles the issue of state-owned companies’ partnerships considering their regulation, the potential of governance increment, as well as how public-private associations can foster innovation. First, we analyze the constitutional norms applicable to state-owned companies and the recent amendments, which enabled strategic partnerships. This constitutional change does not imply bid rigging. Second, we study how the different types of the state-owned companies’ partnerships and their correspondent formalization. Cases exemplify the analysis hereby developed. In the end, we discuss hoe the current changes in Brazilian public law may impact the regulation of the state-owned companies.
