Poder Judiciário brasileiro e a proteção dos direitos humanos: aplicabilidade e incorporação das decisões da Corte Interamericana de Direitos Humanos

Abstract

Esse trabalho procura analisar a atuação do Poder Judiciário brasileiro frente à proteção dos direitos humanos e a utilização por este Poder dos instrumentos de proteção a esses direitos, em especial, a jurisprudência da Corte Interamericana de Direitos Humanos. Tal escolha faz-se importante na medida em que o Brasil, com a aprovação do Decreto Legislativo nº. 89, de 03 de dezembro de 1998, reconheceu a jurisdição obrigatória da Corte Interamericana de Direitos Humanos, sendo, por isso, agora, possível a condenação judicial internacional de violações de direitos humanos cometidas pelo Estado brasileiro. O trabalho foi dividido em quatro momentos importantes: entender o funcionamento do Sistema Interamericano, com foco na estrutura da Corte Interamericana de Direitos Humanos; estudar a incorporação dos tratados que versam sobre direitos humanos no ordenamento jurídico brasileiro; a relação entre Sociedade, Poder Judiciário e Direitos Humanos; e, por fim, a análise dos casos brasileiros perante a Corte Interamericana de Direitos Humanos.

This work analyzes the performance of Brazilian Judiciary about the protection of human rights and its use of the international instruments to protect those rights, in particular, the jurisprudence of the Inter-American Court of Human Rights. This choice is important because with the approval of Legislative Decree no. 89, of 03 December 1998, Brazil recognized the compulsory jurisdiction of the Inter-American Court of Human Rights, and now is really possible the judicial condemnation against human rights violations committed by the Brazilian state. The work was divided in four moments: understanding the functioning of the inter-American system, with a focus on the structure of Inter-American Court of Human Rights; study the incorporation of treaties that deal with human rights in the Brazilian legal system; the relationship between society, the judiciary and Human Rights; and, finally, the analysis of the Brazilian cases before the Inter-American Court of Human Rights.
