Resumo
The work aims to compare Brazilian and Portuguese Law treatment of State liability, including the liability of its agents, particularly in cases involving decisions taken in situations of uncertainty and risk. After a short notice about the way Law deals with such concepts (uncertainty and risk), the article turns to an overview of Brazilian and Portuguese Law treatment of State liability. Finally, the article discuss the standards by which urgent decisions taken by state agents must be scrutinized when such decisions cause damages, trying to consider aspects such as disposable time, probability, reversibility and the role of the precautionary principle.
