Policy paper: alternativas regulatórias para o presente e futuro do trabalho na gig economy


This policy paper is the result of the Research Future of Work and the gig economy, developed by the Center of Education and Research on Innovation (CEPI) of FGV Direito SP, and is dedicated to identifying problems and possible regulatory paths to face the challenges that mark the work in the gig economy. This document was prepared based on the Regulatory Impact Analysis model proposed in Decree No. 10,411/2020 and is based on the following questions: • What are the work-related problems in the gig economy? • What are and for whom are the present and future burdens and benefits arising from the regulation of these problems? • What are the regulatory alternatives to address some work-related problems in the gig economy? While identifying them, we seek to analyze: (i) what problems can be solved or at least minimized from the regulatory options identified? (ii) what are the possible consequences of each regulatory alternative? From these issues, this policy paper is structured in three major parts. Initially, we present a map of problems – extracted from case law, bills and the consulted bibliography – that surround the work in the gig economy. Next, we discuss the burden and benefits, present and future, related to these problems. Finally, regulatory alternatives are presented to address the problems most frequently mentioned in the mapping performed.
