A constitucionalidade do Certificado de Entidade Beneficente de Assistência Social: uma análise em face das decisões do Supremo Tribunal Federal

dc.description.abstractPor mais de 20 anos, discutem-se, na maior instância judiciária desse país, a constitucionalidade das normas que regulam os requisitos a serem cumpridos pelas entidades beneficentes de assistência social (EBAS) para o exercício da imunidade tributária contida no art. 195, § 7.º, da CF e, principalmente, a validade do Certificado de Entidade Beneficente de Assistência Social (CEBAS). No final de 2019, a Suprema Corte sedimentou a validade do CEBAS previsto na Lei 8.212/1991 no julgamento da Ação Direta de Inconstitucionalidade (ADI) 2.028 e, por sua vez, no Recurso Extraordinário (RE) 566.622 definiu a tese de que “A lei complementar é forma exigível para definição do modo beneficente de atuação das entidades de assistencial social contempladas pelo art. 195, § 7.º, da CF, especialmente no que se refere à instituição de contrapartidas a serem por elas observadas”. Na sequência, já no início de 2020, foi também julgada a ADI 4.480, que trata da constitucionalidade de diversos dispositivos da Lei 12.101/2009, entre eles os novos requisitos para concessão do CEBAS e, embora tivesse sedimentado sua validade constitucional por lei ordinária, foi declarada a inconstitucionalidade de vários artigos da norma, entre eles a obrigatoriedade de contrapartida e da gratuidade de prestação de serviços. O objetivo desta pesquisa é apresentar, com base no julgamento oferecido pelo Supremo Tribunal Federal nas diversas ações que trataram do tema, quais os reais requisitos a serem cumpridos pelas entidades beneficentes de assistência social para que possam exercer a garantia constitucional à imunidade, assim como analisar os efeitos dessas decisões tanto para o Poder Público quanto para as organizações das sociedades civis, oferecendo algumas sugestões para um novo marco regulatório do setor, por meio de lei complementar.por
dc.description.abstractFor more than 20 years, the constitutionality of the rules that regulate the requirements to be met by the Beneficent Entity of Social Assistance for the exercise of the tax immunity contained in art. 195, § 7º, of the Federal Constitution and, mainly, the validity of the Certificate of Beneficent Entity of Social Assistance (CEBAS). At the end of 2019, the Supreme Court confirmed the validity of CEBAS provided for in Law 8.212/1991 in the judgment of the Direct Action of Unconstitutionality (ADI) 2.028 and, in turn, in Extraordinary Appeal (RE) 566.622 defined the thesis that Complementary Law is a required form for defining the charitable mode of action of the social assistance entities contemplated by article 195, § 7, of the Federal Constitution, especially with regard to the institution of counterparts to be observed by them. ” In early 2020, the ADI 4.480 was also judged, which deals with the constitutionality of several provisions of Law 12.101/2009, including the new requirements for CEBAS concession and, although it had consolidated its constitutional validity by Ordinary Law, it was declared the unconstitutionality of several articles of the standard, among them the obligation to compensate and the free provision of services. The objective of this research is to present, based on the judgment offered o by the Supreme Federal Court in the various actions that dealt with the topic, what are the real requirements to be met by the Beneficent Entity of Social Assistance so that they can exercise the constitutional guarantee on immunity, as well as analyze the effects of these decisions both for the Public Power and for civil society organizations, offering some suggestions for a new regulatory framework for the sector, through Complementary Law.eng
