A presunção de hipossuficiência da pessoa física pela via do Art. 99, §3º, do CPC: as consequências da falta de regulamentação

Abstract

Este trabalho tem por objetivo analisar as consequências da indevida concessão do benefício de gratuidade de justiça previsto no art. 98 do CPC, com foco específico na hipótese de presunção de hipossuficiência das pessoas físicas como estipulado no art. 99, §3º, do CPC. O estudo explora as principais correntes doutrinárias e estudos estatísticos que se desenvolvem em relação a esse status quo, apresentando, dessa forma, os impactos econômicos e comportamentais ao processo judicial. Este ensaio também discorre acerca da discussão em pauta no Superior Tribunal de Justiça no Tema nº 1.178, a qual visa ponderar a criação de critérios para análise da situação de hipossuficiência dos requerentes da justiça gratuita.

The current paper aims to analyze the consequences of the improper concession of free legal aid provided by the terms of the Article 98 of the CPC, with a specific focus on the hypothesis of poverty’s presumption of natural persons as stipulated in article 99, §3º, of the CPC. This essay also explores the main doctrinal currents and statistical studies that have been developed regarding the current status quo, thus presenting both economic and behavioural impacts on the legal process. Finally, this work essay also brings sight to the current discussion on Theme nº 1.178 by the Superior Court of Justice, which aims to consider the creation of criteria for analyzing the real situation of poverty of applicants for free legal aid.
