Resumo
Considering the whole evolution of the civil procedural science, there is no doubt about the importance of ensuring impartial judges to the exercise of judicial activity. In seat of arbitration, the concern could not be otherwise. As the arbitrator also perform the privileges granted by the jurisdiction, the need to this person be unquestionable impartial and independent from the parties is even greater, since trust is the main requirement for the function such munus. Thus, the work aims to understand can the principle of autonomy for the parties to relativize the prohibition in law, which prevents the operation of arbitrators when incidents in the event of impediment.
