Deregulation of industries with a strong background of state intervention may be a contradictory process. This article analyzes Law 9.362/96, which liberalized the sugar industry, but maintained — and reinforced — a peculiar mechanism for the allocation of import quotas for “preferential markets” (developed countries which adopt protectionist policies for sugar imports). We argue that this quota allocation mechanism is unconstitutional, as prevents access to sugar exportation by potential interested parties, replacing market mechanisms with a binding planification policy.
