Resumo
The objective of this study is to analyze the legal obligation of ANATEL - Brazilian Telecommunication Agency in order to determine how effectively these stipulated responsibilities have been met and, thus, have contributed to the achievement of this agency's mission. This work seeks to analyze if the highly publicized 'independence' attnbuted this organization, is sustained by the effectiveness of its stipulated responsibilities, and by the introduction of fleXlbility and autonomy components in its management model, in such a way as to aIlow for the achievement of it mission. The methodology employed in this study includes document research and semi-structured interviews with agents who have interacted with the organization. The analysis of the effectiveness of these stipulated responsibilities was done according to pre-defined criteria based on a Multicriteria Matrix, developed specificaIly for this purpose, with subsequent veri:fication of the relationship ofthis effectiveness with the attainment ofthis agency's mission. The relevance of this study is restricted to the emphases given to the performance of Brazilian regulatory agencies, the establishment of which has caused muhiple discussions that range from questions of a legal nature to those questions related to the impact of their performance. This study also offers the opportunity to ana1yze to what degree the actual situation of the regulatory agencies is in harmony with the conceptual principIe that gave it origino The results obtained through this study suggest conc1usions that call on directors of regulatory agencies, on those responsible for the formulation of public policy, and on those responsible for the inspection of public organization to reevaluate the referential adopted by the management of those organization as well as to stimulate discussion and on-going study of this subject.
