Resumo
This monograph aims at the analysis of family law, specifically the institute of socioaffective paternity and its reflection in situations like the current 'adoção à brasileira'. The methodology of this study was based on a review of literature searches, doctrinal and jurisprudential law. The analysis occurs, in a first instant, about the concept of socioaffective paternity and the way that social and affective ties have been assessed as dominant in relation to the bond of consanguinity, considering the best interests of the minor. Then, it was brought the adoption and the 'brazilian adoption', and how the last one figures as a crime by the Brazilian Penal Code, and can be solved by the institute of socioaffective filiation. Finally, were reviewed assessments of how Brazilian courts would suit the process of adoption in the new reality of Brazilian family, considering the lack of legal provision, which leads to the judges to decide on this issue. Alongside are presented examples of decisions characterizing jurisprudence on the subject.
