Resumo
This study addresses the institutional model of railway freight transport in Brazil regarding the intramodal competition promoted by regulation, considering economic and legal theory. Currently is preferred the mutual traffic as a rule and the open access stays on a subsidiary position. However, there is a movement towards the unbundling system. Thus, this work analyses the German experience of unbundling in railway sector for learning purposes. Likewise, discusses the current stage of the unbundling model proposed by the Brazilian federal government, outlining some critical considerations.
