Resumo
This research has as objective a systematic analysis of Brazilian jurisprudence over the distribution contracts between the years 1980 and 2000, trying to identify which is the position of our Tribunals about them. On this stream, we could verify that the cases (judgements) are divided in five big blocks, which are: (1) territorial attribution/division; (2) possessory questions; (3) renovation of lease action; (4) rescission of the distribution contracts. This group is divided in (i) contracts subjected to Ferrari's Law ; (ii) fuel and derivatives distribution contracts and (iii) contracts not subjected to Ferrari's Law; (5) relevant processual questions, divided in: (i) necessary joinder of parties and (ii) extrajudicial executive titles. Moreover, once in the majority of cases atypical agreements are observed, the research tried to extract the concept of distribution that was adopted in each case.
