Resumo
There are two forms of judicial review: the decentralized model of North American origin, and the concentrated model, of European origin. This work, in a first part, examines these models into the comparative law, trying to understand its main features. Subsequently, we describe the proposed creation of a constitutional court in Brazil during the National Constituent Assembly (NCA) of 1987-1988, highlighting their differences. Finally, from the discussions in the NCA, we comment on some proposed amendments to the Constitution pending in Congress who want to establish terms to the ministers and expand the indication criteria of them.
