Resumo
This research investigates how Brazil’s Open Finance regulatory model can guide the practical enforcement of the data portability right under the LGPD, ensuring interoperability among service providers. It hypothesizes that uniform technical standards, along with strong sectoral governance and continuous oversight, are crucial to turning the legal prerogative of portability into operational reality. Additionally, it posits that such interoperability enhances user autonomy and competition in the digital marketplace. The hypothetical-deductive methodology, based on bibliographic, normative, and documentary review, assesses whether the Open Finance experience confirms these hypotheses. In doing so, the study contributes to improving LGPD implementation and offers insights for regulatory frameworks in other sectors
