Resumo
This article focuses on the concept of democracy and its correspondent constitutional model in the works of Roberto Mangabeira Unger. It analyses the relationship between law and structural change departing from what Mangabeira Unger has called 'one of the Weimar legacy to Brazilian constitutional order': the transposition of social expectations of income redistribution into the Constitution with no regard to the institutional framework capable of making those expectations come true. Is it possible to devise a political program committed to change that conceives the law beyond the contradictions of constitutional dirigisme? Or beyond a procedural protocol empty of ideas? In order to answer this question the article discusses whether Unger´s formulations are a solution to the challenge of building a new order, one that harmonizes constitutional rights and public policies committed to structural change.
