Resumo
This study aims to analyze the working conditions of maternity in the national prison system. To do so, it contextualizes female incarceration under a genre perspective. It considers that a patriarchal social organization and historical constructions of feminine and masculine contribute to invisibility and stigmatization of the imprisoned woman. It carries out a survey of the most important rights and guarantees provided in the national and international scope of pregnant and mothers prisioners. It notes that the rules examined do not reflect reality and demonstrates that Brazilian prisons do not guarantee the full exercise of maternity. It notices a need to adopt alternative measures to incarceration. It carries out a quantitative and qualitative analysis of the Habeas corpus lawsuits with the substitution of preventive custody in the residence of pregnant women and mothers of children under 12 years of age before the Court of Justice of the State of Rio de Janeiro. It concludes that the benefit of house arrest is not fulfilled in most of the cases under analyzed and seeks to ascertain gaps that prevents an effective right and also proposes possible solutions.
