Resumo
The main propose of this monograph is to present the issues related to two fundamental rights constitutionally granted that (right to membership and res judicata), due to an emerging scientific technique, the DNA Test, are being re-discussed: Which of these rights should prevail? It is possible relativization of res judicata? Should we start to put now, into a comparative framework. From the author point of view is imperative to analyze the constitutional principles involved in this relationship, the principle of legal safety and, from the other side, the principle of the human dignity. This question involves: 1. a wide doctrinal discussion and also 2. the related jurisprudence, both presented in this study.
