Resumo
This research presents a comparative assessement of the regulation models of the nuclear sectors in Argentina - under the responsability of the Autoridad Regulatoria Nuclear (ARN), and Brazil - under the responsability of the Comissão Nacional de Energia Nuclear (CNEN), trying to identify which model is more adequate aiming the safe use ofnuclear energy. Due to the metodology adopted, the theoreticaI framework resulted in criterias of anaIisys that correspond to the characteristics of the brazilian regulatory agencies created for others economic sectors during the State reform starting in the middle of the nineties. Later, these criterias of analisys were used as comparison patterns between the regulation models ofthe nuclear sectors of Argentina and Brazil. The comparative assessement showed that the regulatory structure ofthe nuclear sector in Argentina, under the command of ARN, seems to be more adequated, concerning the safe use of nuclear energy, than the model adopted in Brazil by CNEN, because its incoIporates the criterias of funtionaI, institutional and financiai independence, competence definitions, technical excellence and transparency, indispensable to the development ofits functions with autonomy, ethics, exemption and agility.
