Resumo
This paper aims to discuss the changes brought about by Law 12.462/11, establishing the Special Public Contracting System, popularly known as DRC, in the setting of public bidding for contracting infrastructure related to the World Cup and the Olympic Games. Displays the general bidding law, Law 8666/93, indicating its importance as well as the negative reaction of the doctrine, over nearly 20 years of enforcement. Inserts in this context the Law 12.462/11. Having as background the ADINs 4645 and 4655 filed in the Supreme Court, this work examines the alleged formal and material unconstitutionalities of DRC, trying to reveal that the Law 12.462/11 may be used by the Public Administration as an important tool to achieve the best public interest in light of the principle of efficiency.
