Resumo
Brazil adopts the hybrid system of judicial review, encompassing both the diffuse and the concentrated form. The object of this work is the concentrated form, which is characterized by an objective process where there are no parts in the formal sense and conflict of subjective interests. Priori, objectivity implies that institutions that relate to the subjectivity of the judge, such as the impediment and suspicion, would not apply. The positioning of the Supreme Court approaches this concept, accepting very limited chance of application of impediment and the incidence of suspicion. This position calls for an urgent review by the Court for the reasons given and studies presented in this work.
