Resumo
This work aims to analyze in a purely academic and doctrinaire the state's responsibility in the achievement of reasonable length of civil proceedings, procedural postulate typified in the federal constitution by Amendment No. 45, creating a new section in its art. 5 which provides for rights and safeguards of man. The theoretical basis for this work is evident through the doctrinal research in books and journals in the legal area, performing a collating the views of domestic and foreign scholars, the area of public law. It develops, finally, the concept of dual responsibility of the State, the first being, the state's responsibility as the normdefining tasks to be pursued, and the second civil liability for possible damages caused due to excessively slow processes that violate the postulate of a reasonable duration of proceedings.
