Resumo
The objective of this article is to analyze the legitimacy of the Public Defenders to institute civil class actions, in reason of the new redaction of the item 5th of the Law nº 7.347/85. Checking the institutional tasks of the Public Defenders, which main purpose is to protect and actualize the rights of the citizens, the article concludes that, in order with Brazilian Laws, this entity has legitimacy to protect diffuses rights.
