Resumo
This study aims at analyzing, from the point of view of doctrine and jurisprudence, the discussion encompassing the antinomy between the Warsaw and Montreal Conventions, which stipulate a maximum limit of indemnity to victims of air accidents and the Code of Consumer Protection, which provides a full indemnity for damages suffered because of the service. First, there will be an analysis of the international regulation of air transport in relation to the liability system, to its historical origin and evolution. Then, it contextualizes consumer protection in the Brazilian legal system, emphasizing the liability system of the service and the principle of full compensation for the damage. Lastly, it analysis the antinomy between the laws, seeking at best solution to the current reality of brazilian society.
