Resumo
In this paper ways to promote the improvement of the Brazilian prison policy are discussed, especially regarding the provisional arrest, focusing on contributions that behavioral economics can provide to the Law system. The central issue is how the adopted procedural model currently does not allow to create an environment conducive to freedom, as it does not promote dialogue between the accused and the judge. Economic studies thus could provide important lessons on how to reverse the upward curve in the number of pretrial detainees in the country and the impact of the imposition of custody hearing in the criminal justice process.
