Resumo
In this paper, I argue that understanding Robert Alexy’s dual nature of law thesis as a methodological claim – and not as a substantive claim about law’s essential properties – can be more fruitful to clarify his philosophical project and to rebut some objections against it. With this objective, I point out that methodological options arerelevant to distinguish philosophical projects about the nature of law and I explore how these options can be useful to (i) undermine the separability thesis as the main distinction between positivism and non-positivism, and (ii) erode the binaries positivism/descriptivism and non-positivism/normativism.
