Resumo
This paper begins with the examination of the homophobia as a polysemic concept, with the aim to understand it deeply. For that, we turn to the book written by the franco-argentine author Daniel Borrillo, which contains both the history of this phenomenon and the socio-cultural treatment accorded to it. Next, it will be explained the bases and principles of Classical Criminal Law and its mission to protect relevant social goods that ensure the perpetuation of society. We will also make a comparison between it and the Symbolic Criminal Law, demonstrated by emergency legislation, as a strategy of the State do provide quick (and symbolic) responses to a certain social demand. We will discuss the pros and cons of criminalization, its feasibility and necessity. Finally, we will examine the options open to the Government to deal with the prejudice caused by sexual orientation, that can have preventive or repressive nature.
