Resumo
The objective of this Work is to analyze the changes produced by the Declaratory Statute No. 140/ 2011 in the administrative jurisdiction for licensing. Explained the definition of administrative jurisdiction and its impact on jurisdiction, including an analysis of legal uncertainty for entrepreneurs since the CONAMA Resolution 237/97. I did a research about the constitutionality of provisions of the Resolution, and a specific research in an attempt to identify the criterion used by courts to identify the environmental agency responsible for licensing. Explained the main provisions of this Declaratory Statute and finished with a brief analysis of what we can expect from now.
