Resumo
This paper addresses the issue of risk allocation between the government and the private sector in public procurements governed by Law 8.666/93. The first part of the study highlights the new paradigms of state and the evolution of administrative law in Brazil. The second part describes the traditional model of public procurement in Brazil. The third part discusses the constitutionality of the objective allocation of risks in public procurements. The fourth part provides some guidelines for risk allocation in public procurements in accordance with efficiency considerations.
