Why, even after 25 years of the promulgation of the Federal Constitution which inaugurates the democratic period in Brazil, does the Military Police of São Paulo maintain a pattern of excessive use of lethal force in their actions, despite the creation of a series of mechanisms that seek control of police activity? It is from this question that this study sought to understand what are the determinants factors for understanding the operational standards of the PMESP, and map the main actions of police activities implemented between 1983 and 2012, discussing its limitations and potentials. In general, it was concluded the inability of incremental changes to modify the standard patterns of actions of the PMESP, demonstrating that the choice for more 'forceful' measures to curb crime is, above all, political-institutional, with strong ideological ties.
