Resumo
The Right to Health is enshrined in normative sources of law, whether internal or international. Since the promulgation of the Brazilian Constitution, in 1988, is considered as Fundamental Right. However, in the midst of a democratic state in which there is on one hand a centralized and inefficient state and on the other hand, private initiative focused exclusively on profit, the Right to Health becomes manifestly ineffective in Brazil. Thus, the Third Sector, through its various entities, such as associations, foundations and others non-profit organizations, it becomes an alternative to effectuation of the Right to Health. Based on constitutional and legal procedures, such as the prefer the transfer of resources and competence by the government, the Third Sector is benefited by the social context in which civil society exercises social control and looking empowerment, once the Third Sector is a part of the private sector, even focused only on the public interest, reason may be the key to the fundamental constitutional Right to Health could be finally performed in Brazil.
