Resumo
This study aims at a segment of an ongoing technological development: 3D Printing. The focus of this study adheres to the duality user-consumer/producer-consumer as far as these players unfold their roles in commercial activities. Here with specific interest in the dynamics of their behavior of use of the technology and subsequent need of Legal protection for the defrauded parts. This study suggests as examples, a few problematic scenarios involving consumers as well as other players, such as online platforms and multinational companies that sell 3D prodcuts as well as 3D printing services. The first chapter explores 3D printing and its impact on Intellectual Property, introducing the online platforms and the consequences that may arise regarding Consumer Rights. The second chapter explains 3D printing from its technical point of view, a step by step of its mechanism and possible outcomes. The third chapter contributes with interviews done to related companies, and to law professionals in areas of: Intellectual Property, Consumer Law, and Technology. The fourth final chapter argues and offers by approximation and analogy of theoretical and actual legal cases, possible solutions to existing conflicts involving 3D printing based on the Brazilian Consumer Code.
