Resumo
Green Public Procurement gained more visibility with the amendment of article 3, law nº 8.666/93, which included the principle of the promotion of national sustainable development among the values to be promoted by public bids. This paper intends to approach the related legislation to the theme and the environmental criteria we found on those legislation for the sustainable purchase of public products. To that purpose, some initiatives of the State of São Paulo were analyzed, since this was one of the first to adopt a program of public sustainable contrats focused on the inclusion of social and environmental criteria in their contracts. In addition, the paper also discusses the advantages and disadvantages of the sustainable purchase of products and how the courts have positioned themselves on this particular issue.
