Resumo
This monograph studies evergreening, defined as the use of secondary patenting for the undue extension of patent protection over a creation, under the perspective of competition law in Brazil, the European Union, the United States and India. Based on these countries’ experiences in dealing with this practice, it aims to determine the applicability of the Brazilian competition law and other institutional approaches to the issue.
