Resumo
This study aims to examine critically the new system of Heinous Crimes Law, after the legislative amendments and case law that have occurred since its creation until the present day. The problem of this study was based on the analysis of a slowdown in the Heinous Crimes Law, mainly from the decision of the Supreme Court, which declared unconstitutional the section of the law which provided that the sentence in heinous crimes in the scheme should be fully closed. To prove the thesis that it was essential to bring the scene of the creation of law and its rigor, after their modifications made by law and jurisprudential position, and finally his current situation. Once the review, it was proved that there was a slowdown in the treatment of heinous crimes, but even still rigor compared with common crimes. In addition to also conclude that the purpose of the law should not stop crime, but to become a Criminal Policy in response to society and rigor in the treatment of crimes considered most serious.
