Resumo
This work investigates how the TJRJ considers, within the public service concessionaire’s liability, the way an armed robbery on a bus is treated. After a review of the doctrine on the state's liability, and how this applies to private entities providing public service, we shall present the cases of liability exclusion. We shall then analyze the thesis adopted by the STJ as applicable in the case of armed robberies on buses. Once we establish the treatment under the law, we shall present the results of an empirical study on the decisions issued by the TJRJ in order to try to identify what its position on the subject is.
